The Workers Compensation Legislation Amendment Act 2025 (NSW) was assented to on Monday, 24 November 2025.
The Act introduces reforms to the NSW workers compensation scheme, including changes to how psychological injury claims are defined and managed.
In addition, the Workers Compensation Legislation Amendment (Reform and Modernisation) Bill 2025 was passed on Wednesday 4 February 2026. This Bill builds on the earlier reforms and includes further changes aimed at modernising and stabilising the workers compensation system.
Details regarding commencement dates, supporting rules and transitional arrangements for both pieces of legislation are yet to be provided by the Government.
We are currently reviewing the amended legislation and engaging with legal advisors to fully understand what these changes mean in practice for coal miners. We will continue to monitor developments closely and keep you informed as further information becomes available.
